To be honest, it was pretty clear Renault had lost their way and that their parent company weren't interested in giving them more resources to dig themselves out of the hole they got themselves into. It was clear even in 2005 and 2006 that Renault were punching well above their weight.
I can, yes, but there was nothing in the rules to disallow it. Thankfully, it has since been made illegal.
Todt has got a good CV, granted, but he's a Ferrari man, just as I'm a McLaren man. You also don't that Todt won't be biased. There are a number of other good candidates who could do just as good a job as Todt and be much less controversial.
Ayrton Senna: WDC 1988, 1989, 1990, 1991
McLaren: WCC 1974, 1984, 1985, 1988, 1989, 1990, 1991, 1998, 1999, 2007
McLaren: WDC 1974, 1976, 1984, 1985, 1986, 1988, 1989, 1990, 1991, 1998, 1999, 2008
The Renault spygate issue was decided before the season, when a team which recently won two titles would certainly have still been "in the title race".

Can't you see that in rationalising away LH being winched back on the track is every bit as bad, and destroys your credibility among objective observers?

How do you know that Todt would be a biased dictator? That's your unfounded supposition. Todt has not shown signs of being dictatorial during his management of motor racing teams, with MS, Brawn, et. al. being given considerable responsibility, rather than being kept in line.
