Yesss, but the test is how they work out if it does so or not. . .

Their perfectly entitled to introduce new, more stringent tests, which is what they have done, no argument there.

I have just looked at the FIA technical regulations and it makes no mention to "under racing conditions"; as long as it passes the static tests it is deemed legal!

2.6 Measurements :
All measurements must be made while the car is stationary on a flat horizontal surface.

Yes but you have no proof that the wing was actually flexing, the car was under breaking and there are various things that can cause a wing to shake about. In the redbull flexi wing thread we have pretty much confirmed that the wing is not flexing, rather the front ride height is being altered through aerodynamic load. Unfortunately we dont have any aerodynamic experts to actually tell us what is happening in the video of Vettel's crash with Button but we can be certain that the wing itself is not flexing.
