Kolles tells van der Garde to take it to court

Colin Kolles, team boss of Force India, has told test driver Giedo van der Garde that if he wants a refund of his $2 million, he will have to petition a court.

The Dutch driver launched legal action in Holland against the Spyker team last month claiming that he was not given as much testing mileage as his contract stated. However it has emerged that he has been told that he needs to file papers in England where the Force India team are based.

Kolles has said that the two parties have tried to reach a compromise however van der Garde has rebuffed every solution offered. It is believed that Force India are arguing that van der Garde did not complete as many miles as his contract stated because he held a conflicting contract with Super Aguri.

“This is, at least partly, Giedo s fault,” Kolles explained to Dutch newspaprt Algemeen Dagblad. “Several times we have attempted to settle the matter amicably but every time, our proposals were rejected. He only wants his money back and does not want to consider a settlement. Well, he has to go to court in England.

“There was even a claim by Super Aguri against us. Quite simply though, he was not good enough.”
