SUMMARY JUDGEMENT APPLICATION

Team Lotus is delighted that we were successful at the Summary Judgment Application hearing today and that the Judge threw out Group Lotus' application even before hearing the arguments of the barristers on either side.

Although this decision was never in doubt, it means that we start the 2011 season under the Team Lotus name. Whilst we expected that the Judge would refuse this application, it is good to have the decision in black and white.

The Judge also felt that it was in everyone's best interests to bring the hearing date for the full trial forward and that is now fixed for 21st March rather than us having to wait until Autumn 2011 or even later. We remain confident that we will succeed at the full trial and we can now focus on the challenges ahead in the 2011 FIA Formula One™ World Championship.

I think a merge is needed , honestly how many different threads do we need discussing the same overall topic, no offense intended towards you andy c but these two already exist.

Those threads, whilst interesting reading are related to 1) a driver changing teams, and 2) someones opinion there is too much Lotus around in motorsport.

This thread is information regarding a court case ... the only common denominator is they are all related to the same team.

Using your suggestion we may as well merge all threads that relate to different teams into one thread for each team ... so we would have only 12 "super-threads" on the whole board? .. each with 20000 pages

Although, that is not actually correct as there are threads that don't realte to teams, but within those threads there are references to a team, so I suppose they would then need to be cross-referenced into the designated team "super-thread".

Given the "part-sale" of Renault to Lotus Group and subsequent decision to visually associate the 2011 car with the historically significant cars of the 1980's is just a cynical deployment of their brand...... all I can say is that these Malaysians need to grow up! How utterly ridiculous that 2 Malaysian owned businesses can be in such competition with each other. Add to that the fact that ANOTHER Malaysian business is the title sponsor of Mercedes F1 (Petronas) and you really have to ask some serious questions over the key decision makers up there.

Hell, I live in Singapore which is only 20 minutes from Malaysia.....it hosts a GP.......it has WAY more money than Malaysia.....but it doesn't "spray" it's money against a wall like the Malaysians!

There's no appeal, you've misunderstood what this hearing actually was. There was no legal judgment given on the substantive issues of the case here - the statement from Fernandez is simply spin. The sole purpose of this hearing was for Group Lotus to attempt to get a summary Judgment i.e. they were trying to say that the case was so overwhelmingly in their favour that there is no case to answer and it should be decided instantly in their favour. The Judge had to look at all of the information and decide if that was the case. Evidently, he decided that the evidence is not overwhelming and therefore the issue should go to a full trial for an authoritative ruling.

And believe it or not, not all lawyers are motivated by money (which is your suggestion). I HATE that ridiculous saying - how about if I said the same thing about senior Doctors or Scientists, who can both earn as much or more than most lawyers? People are motivated by money in ALL industries and many others aren't. Wait until you're accused of a crime you didn't commit and see how appreciative you are of a good ethical lawyer. Tell me what you do so that I can insult your profession based on wild stereotypes? No? That's all I'll say on the matter, I've made my point.

What's the flag have too do with it? Lotus F1 is still built at the original location/factory so the heritage is still there.
