They have been working on the diffuser for quite a while now. I think that they don't want to look like hypocrites by protesting then using it themselves also their is the Brawn-Mercedes connection.

McLaren asked to speak at the hearing even though they havent protested at any GP's.

Did they ask but weren't allowed?

From the report given on this forums news page:

McLaren have confirmed that although they will attend next week’s International Court of Appeal hearing, they will not make a formal submission.

The FIA have confirmed that McLaren, who are known to be opposed to the diffuser, will also attend the meeting. But they will not take an active role.

It doesn't say who decided Mclaren won't speak.

[quote="irons_4_ever"]I find it funny there not speaking at the appeal, i think we will see diffusers on the mclaren if the appeal is in favor of them[/quote.

I think we'd see something appearing on most cars, the reason they're not speaking may have something to do with the Brawn-Mercedes connection.

"When questioned about this by media in the past, McLaren personnel have stated that we believe that the diffusers used on the Brawn, Toyota and Williams cars are outside the scope and intent of the technical regulations," a McLaren spokesman said. "We will therefore be attending Tuesday's hearing, but will not be making any oral presentations."

that's a formal protest without speaking.

It would be nice if McLaren came to back up Brawn, Williams and Toyota, especially if they're intent on introducing a double-decker chocolate bar... I mean diffuser.

Well actually Williams use a very clever triple deck diffuser when they first launched the car it was double decker but now it is a triple decker and a very impressive design!
