Looking at the information available, it looks to me as if there would have to be positive evidence that the marshal was waving a yellow flag before any real conclusions could be made.
Ferrari requesting clarification doesn't have any negative connotations that I can see. Where there is controversy, the air needs to be cleared. The FIA confirming that a green flag was being waved at that point is the clarification that is needed. And unless there is good evidence the FIA is lying about this, then it finishes there. Wanting to know what really happened is not the same as wanting the decision overturned. If it could be shown that the stewarding was substandard at the event (which there isn't, at the moment, sufficient evidence I believe) then knowing that would allow teams to ask the FIA and its stewards to raise their game.
Has any team attempted to win a championship through an appeal after the season since McLaren tried it in 2007? I don't remember any examples more recent than that.
