The crane was legal as the rules stood then.
Hungary qualifying he disobeyed team orders(and later apologised) but that does not constitute cheating
This discussion depends on the view that each one wants to see. One person can say that Hamilton hasn't cheated and another person can say that Alonso hasn't cheated (is the same as you said). Or another can say that both of them has cheated. Each one have an opinion.
I only want to add that in the first situation that you said (about the safety car), I think it was absolutely prohibited. In a safety car situation a driver mustn't change speed sharply. FIA put this rule when Fernando Alonso did it in some situations one and two years before, when it was legal, and the stewards thought that it had to change. I know this because on TV commentators said that with this rule Alonso had lost one of his weapons when the safety car enters on the track.
