Two years ago the cars running KERS all had to take ballast out because the weight limit was too low. Now the weight limit has been increased to account for KERS and teams are required to place ballast in the approximate location of their KERS so that they cannot gain a balance advantage by not running it.
The two situations are completely different.

Two seasons ago they weren't running with KERS. And they were damn fast, so they know how to adjust the car without it better than with it.
