A bunch of you will make some really lousy lawyers...taking everything word for word. If Brawn GP took everything 'word for word' in 2009, Vettel would be a 4X WDC now. :hehe:

Someone quoted the article this is related too, I'll struggle to find it again, but I think it did explicitly mention a 2 year gap between cars.


This is what I could find...

22.1 Track testing shall be considered any track running time not part of an Event undertaken by a competitor entered in the Championship, using cars which conform substantially with the current Formula One Technical Regulations in addition to those from the previous or subsequent year.


So does the 2011 Ferrari conform substantially with the current Formula One Technical Regulations in addition to those from the previous or subsequent year?

Again, its all down the word substantially which could be interpreted in many ways...

My opinion is: the 2011 Ferrari car would conform substantially with the current Formula One Technical Regulations. And therefore its my opinion a precedent has been set, and Mercedes cannot be found guilty.

BUT my opinion counts for s***.


Well in any way a current car does not have significant differences to the current car, so Merc dragging Ferrari in is just a bit of a buffer. Ferrari's a separate issue.

But I believe Mercedes argument is; its not a separate issue. By deeming Ferrari innocent (by not calling them to the trial), the FiA have set a precedent, and Mercedes should be treated the same.

Either way, we will find out within the hour.

Then we can all argue about the decision!! :woohoo:

I agree - and Mercedes disagree, saying thats not what the rules say. So the tribunal have to decide who is right I suppose.

Decision of the International Tribunal

The Tribunal, after having heard the parties and examined their submissions, decided that:

Mercedes be reprimanded;
Mercedes be suspended from participating in the forthcoming “three day young driver training test”;
Pirelli be reprimanded.
and rejected all other and further conclusions

Well not the bouquet of roses smell I predicted since page one but more of a supermarket day after valentines day single long stem rose smell. :D

Not harsh enough, were they going to really take part in that test for any logical reason apart from testing their car anyway? I don't see them replacing Lewis or Nico anytime soon with a new upstarting chappy.

Quite an interesting read, if you can be bothered. The interesting part (for me) is the following conclusions at the end of the report:

......Having taken all such matters into account, the Tribunal makes the following findings:

(1) The track testing, which is the subject of these proceedings, was not
carried out by Pirelli and /or Mercedes with the intention that Mercedes
should obtain any unfair sporting advantage.
(2) Neither Pirelli nor Mercedes acted in bad faith at any material time.
(3) Both Pirelli and Mercedes disclosed to FIA at least the essence of what
they intended to do in relation to the test and attempted to obtain permission for it;
and Mercedes had no reason to believe that approval had not been given .
(4) The actions taken on behalf of FIA by Charlie Whiting (having taken advice from the legal department of FIA)
were taken in good faith and with the intention of assisting the parties and consistent with sporting fairness.


Which basically, to me, says "well no-one really meant to do anything naughty"

And the cost of the whole enquiry is to be shared equally between FiA, Mercedes and Pirelli....

Agreed, good read. I wonder how long this thread will now go with the, "they should have been banned" argument.
One thing is sure, Christian Horner is the most butt hurt man in F1 at the moment.

Especially seeing as he was the only TP there from the other teams. Everyone else just sent lawyers. He seemed a bit too keen to see Merc get sent down....
