I think what Pirelli meant to say was that Mercedes didn't or couldn't know they were this year's tires. English can be a bit confusing sometimes.

Originally they said NO 2013 tyres were being tested, then it was 90% 2014 tyres. Yes Merc didn't know what tyres they were on but if they are substantially different I'm sure they can work it out.

Agree, I think a driver would notice the extra grip of the softer tyres compared to the harder ones.

Pirelli and Mercedes
WED 05.06.13, 9:09PM
The Monaco Grand Prix Stewards raised in their report to the FIA an issue concerning a tyre testing session carried out by Pirelli with the participation of Team Mercedes AMG Petronas F1 in Barcelona on 15-17 May 2013[1].

The FIA requested clarifications from Pirelli and Team Mercedes AMG Petronas F1 in this respect.

The FIA also asked questions to Scuderia Ferrari Team, which took part in a tyre testing with Pirelli in Barcelona on 23-24 April 2013.

The FIA requested all the other F1 Teams to provide the FIA with information they may have regarding any tests carried out by Pirelli during the 2013 season.

In the light of all the replies received and in view of the information gathered during this inquiry, the President of the FIA, acting as the FIA prosecuting body, has decided:

To close the case as regard to Scuderia Ferrari Team considering that its participation in a tyre testing organized by Pirelli in Barcelona on 23-24 April 2013 using for this purpose a 2011 car is not deemed to contravene the applicable FIA rules.
To bring the case concerning the tyre testing session carried out by Pirelli and Team Mercedes AMG Petronas F1 in Barcelona on 15-17 May 2013 before the FIA International Tribunal because it results from the inquiry that the conditions of this testing may constitute a breach of the applicable FIA rules.
The FIA International Tribunal is called upon to make a decision in compliance with the FIA Judicial and Disciplinary Rules.

[1] The Stewards' report follows the protests made by Red Bull Racing and Scuderia Ferrari Team on the occasion of the Monaco Grand Prix against Mercedes AMG Petronas F1 concerning its participation in the Barcelona tests (15-17 May 2013).

I think that the FIA really had no option but to bring Mercedes and Pirelli to an International Tribunal.

The Ferrari case was common sense, there never was a case for them to answer and it has rightfully been dropped by the FIA.

The Mercedes one is more interesting, the fact that the FIA have sent it to tribunal almost certainly means that either they didnt give Mercedes permission to test or that the permission was conditional as I believe the FIA may have mentioned after Monaco, where the conditions were not met!

I expect fines and loss of points for Merc.

The only ban that makes sense is to make-up for the 1000K testing, so perhaps no Friday practice 1 sessions for Merc for a few races.

Hard to determine what should happen to Pirelli if they are found guilty - which seems likely on the surface of it. Their contract may have some provisions covering this sort of thing.

Race ban or massive fine is what I'm expecting, shame

I would think its going to be a fine. A race ban would be a shame - unless they just deduct team points only - as the drivers are not to blame in anyway on this.

I don't think they can do anything to Pirelli. Worst case scenario, they piss Pirelli off, and Pirelli walk away - isn't it a bit late to be introducing a new tyre supplier for next year?

Yes it is too late. Bridgestone aren't interested and that Hancook one says they need three years to prepare if there's no testing.

Indeed. I just hope they don't fiddle with the results of Monaco, I hate it when that happens.

I don't see how they can? Because if they remove those results - they'd have to invalidate all future Merc results for the rest of the season - because whatever advantage they had for Monaco, they would still have for the rest of the season.

I think they would probably do what they did with Schumacher in 97, take ALL points away but leave the results of the races as they were, although the two cases couldnt be more different!
